About these Terms

These Terms govern access to and use of MusicTradeIQ, including its dashboard, Explorer, forecasts, signals, Insights and associated content. The service is operated by Music Industry Consultancy Limited.

By accessing the service, you agree to these Terms. MusicTradeIQ is currently available free of charge and is intended primarily for business and professional users. If you use it for an organisation, you confirm that you have authority to accept these Terms on its behalf.

What MusicTradeIQ provides

MusicTradeIQ organises aggregate customs statistics, public policy material, calculated indicators, modelled forecasts and editorial analysis to help users investigate international music-product markets.

It does not provide retailer sell-through data or company-level shipment intelligence unless a future feature is expressly and accurately identified as such. Free access does not promise that every feature will always remain available or that the service will always be offered on the same basis.

Information only — not advice

MusicTradeIQ provides general business intelligence. The service and its content do not constitute legal, financial, investment, tax, customs, tariff, regulatory or other professional advice. They do not recommend entering, leaving or changing a market; appointing or ceasing to trade with a supplier; changing prices; purchasing inventory; making an investment; or taking any other commercial decision.

You must exercise your own professional judgement, independently verify information material to a decision and obtain appropriate specialist advice where necessary. You remain solely responsible for decisions made, actions taken or not taken, and results arising from your use of the service.

Data, calculations and forecasts

Customs and third-party information may be incomplete, delayed, revised, reclassified or affected by differences in valuation, currencies, timing and reporting practice. We aim to identify sources and limitations, but do not warrant that content is complete, accurate, current or suitable for a particular purpose.

Forecasts, momentum measures, opportunity scores, signals and other forward-looking outputs are modelled estimates derived from historical data and assumptions. They are not guarantees of future values, demand or commercial outcomes.

Accounts and security

You must use your own authorised account, keep access secure and provide accurate profile information. You must promptly notify us if you reasonably suspect unauthorised access.

You may not share access credentials, impersonate another person, attempt to bypass access controls, interfere with the service or use it unlawfully.

Permitted use

You may use MusicTradeIQ and reasonable extracts from its outputs for your organisation’s internal business analysis, with appropriate source acknowledgement where material is reproduced.

You must not resell, republish or commercially redistribute substantial parts of the service; create a competing database from it; conduct unauthorised automated extraction; remove source or limitation notices; or present modelled information as observed fact without our written permission.

Intellectual property and sources

MusicTradeIQ’s software, presentation, taxonomy, calculated measures, editorial content and branding are protected by intellectual-property rights belonging to Music Industry Consultancy Limited or its licensors.

Underlying official or third-party data remains subject to the rights, licences and attribution requirements of its original provider. A link or reference does not imply that the provider endorses MusicTradeIQ.

Third-party services and links

The service may link to official agencies, industry bodies, publications and other third parties. We do not control their availability, security, content or privacy practices, and links are supplied for context rather than endorsement.

Availability and changes

We may maintain, change, suspend or withdraw preview functionality and may correct or revise content when better information becomes available. We do not promise uninterrupted or error-free availability.

We may suspend access where reasonably necessary for security, suspected misuse, legal compliance or protection of the service and other users.

Limitation of liability

To the fullest extent permitted by law, Music Industry Consultancy Limited excludes implied conditions, warranties and representations relating to the service and will not be liable for any decision made, action taken or not taken, or loss incurred in reliance on MusicTradeIQ or its content.

In particular, we will not be liable for loss of profit, revenue, sales, business, contracts, opportunity, anticipated savings, goodwill or data, or for indirect or consequential loss arising from use of—or inability to use—the service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud or fraudulent misrepresentation, or death or personal injury caused by negligence. Any limitation will apply only to the extent that it is lawful and reasonable in the circumstances.

Privacy

Our Privacy Notice explains how personal information is collected and used. It forms part of the information governing your use of MusicTradeIQ and is available at musictradeiq.warwick-musi-8799.chatgpt.site/privacy.

Ending access

You may stop using the service at any time. We may end or restrict access if you materially breach these Terms, create a security risk, use the service unlawfully or if the open-access service is withdrawn.

Provisions intended to continue—including those concerning intellectual property, responsibility for decisions and liability—will survive the end of access.

Governing law and changes

These Terms and any non-contractual dispute arising from them are governed by the law of England and Wales. Subject to any mandatory rights that apply, the courts of England and Wales have exclusive jurisdiction.

We may update these Terms to reflect changes to the service or law. The effective date identifies the current version. Material changes will be communicated where appropriate; continued use after they take effect constitutes acceptance of the revised Terms.
